Registration
Evergreen Escape considers registration for a trip binding for both the traveler and the travel agency upon timely payment of the deposit, as stated in the invoice sent when booking the trip.
Along with the invoice, the travelers has received a link to terms and conditions.
Price and payment
All excursions, bus travel, driving with special vehicles, all sailings and boat trips and, as a general rule, all entrance fees for the program are included in the price. The prices include hotel with full board per person in a shared double room – unless otherwise expressly stated for the individual destination.
Supplements for single rooms are mentioned at the individual destinations. If you want a shared double room and there is no possibility for this, a supplement will be charged for a single room.
The price possibly covers Danish Tour Leader and English-speaking local guides, unless otherwise stated in the itinerary.
Tips for local guides and drivers are not included in the price of the trip. There are some exceptions which are clearly stated during the individual journeys.
The price does not cover cancellation insurance, travel insurance and visa.
In cases where a visa is included in the price, it appears under the individual travel destinations.
Registration deadline
Registration for the trip should, as far as possible, take place within 10 weeks before departure. This is due to Evergreen Escapes deadlines with airlines and business partners.
Registration later than 10 weeks before departure can often be done, but may also result in an increased price.
Payment of the trip
When registering, a deposit of 10% of the price of the trip is paid, but a minimum of USD 500/=. If the deadline for paying the deposit is not met, the offer will expire. The remaining amount must normally be paid 10 weeks before departure unless special circumstances apply. If the deadline for payment of the balance is not met, the registration will be deemed to have been cancelled without valid reason and the deposit will not be refunded.
When booking a trip less than 10 weeks before departure, the entire price of the trip is paid at the time of booking.
Unforeseen events/force majeure
In the event of a flight strike or other strike affecting aviation, Evergreen Escape or the airline can assist with changing the reservation. However, this can only be done the moment a strike is a reality, and only according to the airline’s instructions. If a strike has been announced – and thus has not yet come into effect – it is at the traveler’s own expense if they wish to change or cancel a reservation.
Evergreen Escape cannot be held responsible for external incidents or incidents caused by third parties. E.g. delay due to weather conditions and baggage that does not arrive. In the event of such incidents, the traveler must contact the airline in question, which is responsible for the transport.
Change of itinerary
itinerary. This is a decision made by Evergreen Escape in consultation with our business partner. In the event that part of the planned itinerary must be changed due to force majeure or force majeure-like situations, Evergreen Escape cannot be held financially responsible for this.
It may happen that the departure and return dates have to be moved due to changes in the airlines’ times or cancelled flights, for which Evergreen Escape cannot be held responsible.
Change of price
Evergreen Escape reserves the right to increase prices as a result of circumstances the travel agency cannot take into account in advance, e.g., increased air and car transport costs, increased taxes and fees, oil prices and changing exchange rates.
The price increase will not exceed 10% of the price of the trip, and it will be notified no later than 21 days before departure.
Cancellation
The journey is carried out with a minimum of 10 participants, unless otherwise stated. If the trip is cancelled due to too few participants, this will happen no later than one month before departure. Evergreen Escape reserves the right to make necessary changes as a result of the number of people registered for a package tour being less than the minimum stated in the agreement. If the traveller then does not wish to participate in the trip, the amount paid will be refunded, while no further claims can be made.
A trip can also be cancelled if acts of war, natural disasters, life-threatening infectious diseases and other similar events occur at the destination within a period of 2 weeks before departure.
Limitations on Evergreen Escape’s liability
The airlines have the direct responsibility for the correct implementation of the transport according to the Warsaw and Montreal Conventions, EU Regulation 889/2002 and 261/2004 and the Aviation Act.
Evergreen Escape limits its liability to the amount limits applicable at any time, which appear from the Warsaw and Montreal conventions (air transport), the Athens convention and EU regulation 392/2009 (sea transport) and the COTIF convention and EU regulation 1371/2007 (rail transport). Evergreen Escape’s liability for damages cannot therefore exceed the amount that applies to the carriers who have direct responsibility for the transport.
The amounts are stated in SDR. The SDR is a unit of account used by the International Monetary Fund (IMF). SDR is formally the means of payment that the central banks use among themselves. The current SDR exchange rate (XDR) can be found on the website for The National Bank.
The limits on the maximum compensation under the Warsaw and Montreal Conventions are set to:
In the event of the death or injury of passengers: 113,100 SDR – if the airline can prove that it has not acted negligently or acted improperly, or if the incident is due to the negligent or improper behavior of a third party.
In case of damage caused by a delay in passenger transport: 4,694 SDR.
In the event of destruction, loss, damage or delay of luggage: 1,131 SDR.
The limits on the maximum compensation according to the Athens Convention and EU Regulation 392/2009 are set to:
In the event of the death or injury of passengers: 250,000 SDR to 400,000 SDR – depending on the cause of the injury and the proven fault of the carrier.
In case of destruction, loss or damage to hand luggage: 2,250 SDR.
In the event of destruction, loss or damage to vehicles, including luggage in or on the vehicle: 12,700 SDR – the carrier is only liable for damage caused due to fault on its part.
In case of destruction, loss or damage to luggage other than hand luggage and vehicles: 3,375 SDR. So-called “valuables” are not replaced according to the regulations.
The limits on the maximum compensation according to the COTIF convention and EU regulation 1371/2007 are set to:
In case of death and injury to passengers: 175,000 SDR.
In case of loss or damage to objects: 1,400 SDR. In case of total or partial loss of a vehicle: 8,000 SDR.
For damage to items left in the vehicle: 1,400 SDR – the carrier is only liable for damage caused by a fault on its part.
The traveller’s participation on trips with Evergreen Escape requires that the traveller is familiar with and agrees with the information received, which the traveller has obtained through the requested travel program and price list, the information received in connection with sending the invoice, including practical travel tips and itinerary, and finally our departure documents, containing airline tickets, travel insurance etc., which are sent before departure.
It is expected that the traveler behaves considerately and responsibly and follows the instructions of Evergreen Escape and our partners.
Travel documents
Evergreen Escape sends relevant travel documents and tickets electronically to the traveller no later than 7 days before departure. It is the traveller’s responsibility to provide the correct email address. Evergreen Escape cannot be held responsible for e-mails that are not delivered, due to the traveller’s possible firewall or spam filter, as well as change of e-mail address, about which Evergreen Escape has not received information.
On receipt of the travel documents, the traveller has a duty to review them and immediately respond if the information is not in accordance with what was agreed. It is specifically the date of travel and the name of the traveller that must be checked. The name must appear exactly as it appears on the passport. If the name is entered incorrectly, it costs from USD 100 up to the entire price of the plane ticket per person, if the flight ticket has been issued. Should an incorrect name be provided, the traveller is not entitled to participate in the air transport or to receive a refund of the amount paid.
Departure and check-in times
The traveler undertakes to meet on time at the indicated meeting places.
Passport and visa
For most of our overseas destinations, passports must be valid for 6 months after the date of return. Exceptions to this can be seen during the individual journey.
All information about passports and visas only applies to persons with a Danish passport.
Evergreen Escape must be informed if the traveller is not a Danish citizen, if the traveller has dual citizenship or if the traveller is traveling on a diplomatic passport. Foreign nationals and dual nationals should check any visa and passport requirements before booking travel. Information and information about this can be sought at your own country’s embassy.
Visas for Tanzania and Uganda can be purchased at the airport of destination. Visas for Kenya must be ordered online no later than 7 days before departure, and preferably 2 weeks before.
Vaccinations
It is the traveller’s responsibility to arrange for vaccinations that are necessary for the completion of the trip. The fulfilment of vaccination requirements must be documented by means of an international yellow certificate.
Evergreen Escape can provide information on vaccination requirements, but not necessarily on other recommended disease prevention. The traveler should always consult their own doctor or specialist travel medicine clinic in connection with vaccination and disease prevention. When Evergreen Escape can inform about recommended vaccinations or prophylaxis, it is a service without medical liability.
Cancellation insurance
Evergreen Escape recommends that the traveller take out sickness cancellation insurance, which covers cancellation costs if participation in the trip is impossible or significantly hampered due to death or acute illness/injury that requires hospitalization, doctor-prescribed bed rest, or what can be equated to this, on the part of the traveller self or spouse/cohabitant(s), parents, parents-in-law, children, grandchildren, siblings, grandparents, sister-in-law, brother-in-law or traveling companion.
Evergreen Escape receives remuneration for the sale of cancellation insurance.
The cancellation insurance must always be taken out at the same time as booking the trip/paying the deposit and is non-refundable regardless of the reason for cancellation. For clarification of technical questions and applicable insurance conditions, please refer to the insurance company.
Travel insurance
Evergreen Escape strongly recommends that all travelers take out travel insurance during the journey, which covers illness and transport home. It is the travelling duty to be adequately insured in all respects in connection with the journey. Evergreen Escape cannot be held responsible for expenses incurred due to the travelling lack of insurance. For clarification of technical questions and applicable insurance conditions, please refer to the insurance company.
Refund of deposit
If the traveler has ordered and paid a deposit for the trip and, contrary to expectations, cannot get travel insurance from an insurance company – Evergreen Escape will of course refund the full deposit – incl. possibly. cancellation insurance. If the traveler cancels for other reasons, we refer to our normal cancellation rules.
Cancellation
Weeks before departure, half of the amount paid will be refunded. Possibly. cancellation insurance is non-refundable.
If acts of war, natural disasters, life-threatening infectious diseases and other similar events occur at the destination within a period of 2 weeks before departure, the entire price of the trip will be refunded. However, repayment is provided that
the Ministry of Foreign Affairs advises against travel to the area in question and that the events have occurred after the travel was ordered.
For tailor-made trips for both individuals and groups, the deposit and any plane tickets are not refunded, regardless of the time of cancellation.
Transfer of travel
Under certain circumstances, the trip can be transferred to a third party (e.g., family or friends) for a fee of USD 150/=. In addition, if there are any costs for name changes on flights and hotels and more. In some cases, our subcontractors restrict a transfer in whole or in part. For example, it may be that a brand new plane ticket has to be bought. Please be aware that most airline tickets included in a package tour cannot be changed or refunded once they have been ordered. Transfer can only take place if the person to whom the package tour is transferred meets the necessary conditions and requirements for completing the trip, including passports, visas and health requirements.
Absences and unused services
If the traveler does not show up or otherwise fails to use the services that have been ordered, Evergreen Escape cannot claim compensation for the unused services.
Complaint
If the traveller experiences deficiencies during the trip, Evergreen Escape must be informed as soon as possible. The traveller must do this so that Evergreen Escape has the opportunity to correct the deficiencies.
On group trips with a Tour Leader, the traveller must advertise to the Tour Leader on the spot. If the Tour Leader does not solve the problem, the traveller must contact us immediately on tel. +254 7 9191 8888.
On individual journeys, the traveller must advertise to the subcontractor on the spot (e.g. business partner, hotel, local guide or driver) who provides the service that is deficient. If they do not solve the problem, the traveller must contact us immediately on tel. +254 7 9191 8888.
If the traveller does not complain immediately, as described above, the traveller may lose the right to complain about the deficiencies subsequently.
Claims for compensation, a proportional reduction in the price of the trip (compensation) or compensation for inconvenience – as a result of defects that have been properly complained about and which have not been remedied by Evergreen Escape – must be submitted within a reasonable time after the end of the trip. Otherwise, the traveller loses the right to make claims against Evergreen Escape.
